recieved this letter (shown below) from a concerned citizen

Acting Chief of Police has a Felony Conviction for Falsifying
a Police Report! How can this guy even be a cop let alone a Chief
of Police in a profession predicated on honesty and integrity?
This is another shortsighted and reckless decision
by Jerry Hanson, Mary Stephens, Hank Hohenstein and others.
McKinney is obviously another one of Jerry's minion's brought
in to do his biding. Everyone including city officials knew about
this guy's background months ago and some even as far back as
1997 when he first appeared in DHS as the interim Chief. In 1998
McKinney was the Interim Chief of DHS, but was forced to resign
when his criminal conviction for Falsifying a Police Report was
imminent.
Mary Stephen's openly admitted in an interview with the Desert
Sun (March 22, 2005) that she was aware of McKinney's conviction
and that she was confident he would "uphold the position
with integrity".
What are you nuts? This man was convicted of a crime that showed
he had no integrity. Mary, surely you jest! Who are you to judge
the integrity of another? I am sure that Stephens is also aware
of all of the following facts documented below since she is a
close friend of McKinney's, and partly responsible for him being
hired a second time. One scandal wasn't enough?
However there is a slight chance she is not aware of these serious
issues since NO background check was conducted on McKinney until
several months after he was already employed by the city! This
is a violation of state law governing the hiring practices of
police personnel. In addition, McKinney has been working for several
months without having undergone a Psychological evaluation prior
to employment; another violation of the law (1031 California Government
Code).
Furthermore, the background investigation was conducted by McKinney's
long time friend and former partner who McKinney hired to do his
background without any other oversight of the investigation by
city personnel - Hmmm...Does there appear to be a conflict here?
The reason McKinney did this is obvious, McKinney could not pass
a legitimate background investigation conducted by a competent
investigator in accordance with state law and California POST
(Peace Officers Standards and Training) guidelines.
Read McKinney's attached resume, which should be cut and pasted
to Jerry's, Mary's, and Hank's growing resumes outlining gross
incompetence and collusion.
WALTER McKINNEY's
Resume
1. June 1998, McKinney charged with 118 PC (Perjury) and 118.1
PC (Peace Officer filing a False Police Report).
2. October 1998, McKinney convicted of 118.1 PC (a Felony)
3. December of 1998, L.A. DA's Office does not prosecute charge
of perjury against McKinney after McKinney had perjured himself
under sworn oath at the preliminary hearing. DA's Office agrees
not to prosecute McKinney for perjury for his "nolo-contende"
(no contest plea – same as entering a guilty plea).
4.
November 1997, McKinney with all of his pending legal matters,
is hired as the acting Chief of Police at Desert Hot Springs.
5. April 1998, McKinney resigns from his position as the Acting-Chief-of-Police
of DHS. This is due in part to his receiving notification of his
pending conviction, which would automatically preclude him from
being a police officer in the State of California.
6. March 2005, McKinney is again hired as
the Acting-Chief-of-Police at DHS. Immediately upon being hired,
Mckinney solicits several Citizen Complaints on his own by passing
out complaint forms to anyone willing to fill one out. McKinney
then initiates several Internal Affairs investigations against
officers and supervisors all of which were without merit and were
unfounded. This was done to intimidate a workforce that is comprised
of mostly probationary officers and supervisors.
In addition, McKinney terminates a respected probationary Sergeant
without cause, and demotes the most competent member of the department,
a Police Lieutenant citing "budgetary reasons" (then
he immediately recruits for an Assistant Chief of Police?) This
again is done to intimate department personnel; and in essence
has created a hostile work environment, which will ultimately
force the city into future litigation.
7. McKinney is hired without a background investigation being
conducted by the City, which is a pre-requisite and legal mandate
"prior to employment" under 1031(d) of the California
Government Code. Several months after McKinney is hired, he employs
his friend, and former partner, Reggie Stewart to conduct his
background investigation. Stewart has not been a police officer
since 1988, and has no formal police investigative experience
(he has never been a sworn Investigator or Detective).
In addition, Stewart is not a POST (Peace Officer Standards and
Training) certified background investigator. Almost every police
agency in California uses their own Detectives who are POST certified
background investigators, or retired police personnel who are
POST certified investigators to conduct backgrounds on prospective
applicants.
DHS has three independent contractors who they have used in the
past to do all background investigations. All of these contractors
are retired police investigators who are also POST certified background
investigators, yet McKinney hires his friend to do his background?
The reason for this is simple. McKinney could not pass a background
investigation conducted by a skilled investigator using POST guidelines,
and state law. No agency in California would hire McKinney as
a police officer, let alone a Chief of Police with his criminal
conviction for falsifying a Police Report and his track record
as a police administrator.
· (Ask any Chief of Police – if they would hire an
officer with a conviction for falsifying a police report. McKinney
has what is referred to as a "Brady Issue". What this
means is that anyone with a "Brady Issue" is regarded
as having credibility issues and is black-listed by the DA's office,
meaning they cannot testify in court (what use is a police officer
who cannot testify in court?).
· As a result of McKinney's background in this area, all
DHS officers get a "Brady Letter" from the Riverside
DA's Office attached to their reports stating that the DHS Chief
of Police has "Brady Issues". This is being done by
direction of Supervising DDA Sue Steading, which was addressed
in an e-mail to Deputy District Attorney's in the Indio Office.
· Also, DHSPD has attended more Pitches Motion's (requests
by the defense to review an officers personnel file) against its
officers in the last few months since McKinney has been the Acting-Chief,
then in the entire history of the department. This is a result
of McKinney's own background and credibility issues.
8. Also under 1031 of the California Government Code, as part
of a thorough background investigation (which we have already
established that McKinney did not undergo) McKinney is mandated
by law to submit to a Psychological evaluation prior to employment.
Again, this was not conducted. McKinney has been working for several
months in a sworn capacity as an Acting-Chief-of-Police without
a "real" background investigation, or a psychological
evaluation. The big question is how can someone who constantly
breaks and skirts the law be trusted to uphold it? How can McKinney
be trusted with his credibility issues to hold the personnel under
his command to the highest standards?
9. In return for his service, McKinney rewards Stewart by hiring
Stewart as a Sworn Detective. This is done before Stewart has
passed a background investigation, or completed a state (POST)
mandated re-qualification course. The re-qualification course,
if completed would renew Stewart's certification as a qualified
police officer in the State of California; without it, he is merely
a civilian (Stewart is scheduled to attend this course in October).
Furthermore, absent a completed background investigation (currently
being conducted by a DHS Sergeant – one of McKinney's minions,
being used to rubber stamp the investigation), and Stewart not
attending a POST re-certification course, McKinney has felt it
necessary to send Stewart to a two-week "Homicide Investigator
Course" at San Bernardino County Sheriff's Department (09/19/05
to 09/30/05).
10. Further more, McKinney's character is questionable for several
reasons mentioned above as well as the fact that while the Acting-Chief
of DHS in 1998, he had a sexual relationship with one of his female
officers (the only female officer on the department at DHS) and
subsequently lived with her (FACT). There is also rumored that
she filed a report with the Department of Social Services (Riverside
or Los Angeles Office) against McKinney for child abuse issues
involving mental abuse of her son by McKinney. Upon his return
to DHS in 2005, he has created a "Specialized" assignment
for Officer Heath, sent her to specialized training, and awarded
her a 5% pay increase. All geared toward keeping her happy, and
quiet.
This is not the first time McKinney has had a sexual relationship
with one of his employee's. While as the Chief of Police in Hawaiian
Gardens, McKinney was involved in a relationship with his secretary.
This relationship carried over into the workplace and involved
"inappropriate" conduct on-duty. Furthermore, on at
least one occasion, it is rumored that McKinney physically abused
his secretary by pushing her into a filing cabinet.
If McKinney tries to deny either of these two relationships, names
of both individuals will be provided.
11. In Addition, when McKinney returned to DHS in 2005, he had
no intention of being the Chief of Police; his main goal was to
become the next City Manager. McKinney saw how lucrative this
position was for Jerry Hanson. He had the support of Jerry Hansen
and his long time friend Mary Stephens that prompted him to submit
his application for the position of City Manager. It was not until
recent legal matters and public scrutiny surrounding his closest
supporters did McKinney realize that becoming the City Manager
was a greedy pipe dream. McKinney then withdrew his application.
However, it is rumored that McKinney still has his eye on the
brass ring.
Now, the question he needs to answer for the residents of DHS
is what has he done to find a permanent Chief of Police for the
City? What has he done for the city since becoming the Acting-Chief-of-Police
other than furthering his own political agenda? (Painting patrol
cars black and white in a city plagued with drugs and crime is
hardly a strategic plan or a major accomplishment).
An FOI should be requested on his e-mail, work phone number, and
cell phone number to see whom he is communicating with in the
political and business world. I would venture to guess that Walt
Luce and other key developers in the city are on McKinney's speed
dial, and that you will not find many law enforcement contacts
or other Valley Chief's of Police in his address book or e-mail
list.
By McKinney's own admission, he and his wife own a financial consulting
business that has been doing "business" in the city
for seven or eight months prior to becoming the interim Chief.
McKinney has boasted in a meeting in front of the entire department
that this business will make over $500,000 this year alone. There
is no doubt that during these business meetings, McKinney, Hanson,
Luce, Stephens, and others have been planning to destroy Chief
Hill's career in order to find away to sneak McKinney back into
the city. McKinney is also on contract with the city. Someone
needs to request a copy of his current contract to see if it mirrors
Hanson's.
12. McKinney continues to use bribes to gain favor and support
from department personnel. Sgt. Eddie Cole (his former partner
in Los Angeles and long-time friend who worked for McKinney at
the L.A. Housing Authority Police Dept. and at Hawaiian Gardens
Police Dept.) was given a position to supervise a "special"
enforcement detail, which will include a team of four officers
and a sergeant. These resources will be pulled directly from the
existing patrol force that is already overburdened and understaffed.
In order to augment the ranks of a depleted patrol force, McKinney
is processing police applicants that have serious background issues,
including credibility and integrity issues. Most of these applicants
were screened by DHSPD personnel months ago, and were rejected
for various reasons, including criminal misconduct while employed
as police officers with other law enforcement agencies. Yet McKinney,
who obviously feels sympathetic towards these individuals who
he shares something in common with, does not find a problem with
processing them to be police officers in DHS.
McKinney has directed his friend, Sgt. Cole, to oversee the application
screening process. Sgt. Cole's interest in getting officers hired
is merely selfish and self-serving. The sooner officers are hired,
the sooner he can supervise his "special" team. McKinney
has directed supervisors (Sergeants) who are not POST certified
background investigators, and possess no background investigation
experience, to conduct these investigations. Again, this is another
attempt by McKinney to control and rubber-stamp these investigations.
In addition, no agency in California uses their patrol supervisors
to conduct background investigations.
McKinney hired someone to do his background and repaid them with
a job. He hired an outside investigator to conduct several bogus
Internal Affairs Investigations, wasting city funds. Yet he does
not find it important enough to hire a skilled investigator to
conduct background checks on officer candidates? Again the reason
is obvious to any law enforcement professional. None of these
candidates, including McKinney would pass a legitimate background
investigation. Under Chief Roy Hill's administration, every officer
underwent a POST background investigation, conducted by a skilled
and certified background investigator, prior to his or her employment.
Mckinney continues to make reckless decisions at the expense of
DHS residents. After all, McKinney does not live in DHS and the
officers and support personnel he hires will not be patrolling
his neighborhood. McKinney does not even live anywhere in the
Coachella Valley. McKinney does not even live in Riverside or
San Bernardino Counties. One would have to ask why McKinney would
drive five hours round trip to work in DHS?
13. Furthermore, McKinney is not qualified to be a Chief of Police
by industry standards. He has never attended any formal training
that is generally required of a candidate seeking a position as
a Chief of Police (SLI, West Point Leadership School, POST Management
Course, Command College, or the FBI Academy). These are all formal
training courses that almost every Chief of Police possesses in
the State of California. In addition, in a recent job announcement
recruiting for the position of Assistant Chief of Police, the
City of Desert Hot Springs in their bulletin state that it is
"highly desirable" if the candidate possesses certification
from the POST Command College, and the FBI Academy.
14. And finally, under 1203.4(a) PC McKinney is not legally permitted
to possess, own, or have in his custody or control any firearms.
Yet he wears a police uniform with four stars, a "tarnished"
badge, and a gun-belt with a gun every day.
McKinney has chosen once again to resurrect his failed career
in Desert Hot Springs at the expense of others. Chief Roy Hill
was a credible administrator and visionary leader respected and
loved by his officers and citizens. McKinney is a liar, who is
hated by many, and respected by no one.
This is whom city leaders (Jerry Hanson, Mary Stephens, Hank Hohenstein)
hired into a critical position to oversee the day-to-day operations
of an agency entrusted with protecting the citizens of DHS. This
is again a reflection of their reckless and shortsighted decision
making ability. We hope and pray that the police officers and
citizens of DHS do not have to make the ultimate sacrifice just
to satiate the political and economic aspirations of a few greedy
individuals.

DHS Police Chief fired for undercover possible
criminal activity by Council members and General Manager?

we and others have been saying for almost a month now. Hate
to say this but "We told you so". Lets see how DHS corruption
apologist Bill Effenger spins/smokes and mirrors this on his public
website.
Palo
Alto attorney Robert Aaronson said that while Hill worked for
the city, he uncovered what he described as "salary
manipulation issues" and individuals using their official position
to gain personal profit in land deals.
"(Hill)
saw sufficient evidence to create enough probable cause that someone
needed to investigate," Aaronson told The Desert Sun.
City
Manager Jerry Hanson and other city officials had little to say
about Aaronson's allegations.
"I
can't comment to that," Hanson said, regarding Hill's termination
or statements concerning his whistle-blower status.
Aaronson
said the "salary manipulation" refers to the fact that "someone
receives his severance pay although he's not severed." Aaronson
would not say if that was a reference to Hanson.

Heard
on local Channel 2 news that DHS City Manager is looking into
dissolving our police department. Now we know why
they fired Roy!! Our assumptions and rumors where right!.

We were
right as usual!! If we get the sheriffs dept again, we will get
back to the horrible long response times and indifferent policemen.
The service in Palm Desert is not that great.
This is not good for DHS. Our response
times are better with local officers. Less than 2 minutes
usually. vs the usual half hour to 45 minutes for the sheriff. Just
ask those who wait and live in Mission Springs area that is unincorporated
county. The accountability will be lost.
Haven't the people of DHS had enough of this
non stop BS? Time for the leadership and management to go!!
Our explosion of quality growth is directly connected
to our top notch (but under staffed) police department.

Uken's Opinion piece in the Desert Sun regarding Roy Hill.

Dear
Friends Of Desert Hot Springs
First,
Hanson fires the Police Chief and he and the City Council have
no comment regarding the firing, other than he was not under
investigation for anything. "The city refused to give any reason
for
Hill's firing but issued a statement that he is not under
investigation for any wrongdoing. The city's public information
officer, Teresa Thompson, confirmed the dismissal and that Hill
is not
being investigated for anything".
They spend a week dodging the media and refusing to answer questions
from the public.
Hanson replaced Chief Hill with hired gun Walter McKinney, a man
convicted of falsifying a police report, the same charge that
Chief
Hill fired four officers for, setting the stage for a
multi-million dollar wrongful termination lawsuit from those four
ex-officers. After all, how can you fire a guy for falsifying
a
report when your Police Chief has a criminal conviction for the
same
thing? My God! Is that stupid or what? Why would
you do that?
Next, a story on TV about Hanson making $322,000 in salary followed
by a week of increased pressure on Hanson and the City Council
to justify why, with Hanson saying, "'I'm worth every damn penny.'"
Then Bill Garrett, executive director of the California City Manager's
Foundation, calls Hanson's contract and resulting salary "Malarkey",
stating, "it doesn't "pass the smell test."
Next Hanson claims he's somehow a victim in all this because someone
leaked his ungodly salary!
Hanson then starts an investigation into this using a private
firm,
stating, he did not trust the police department, Sheriff's Department
or District Attorney's Office.
"I don't trust (the departments)," he said Friday in a meeting
with
Desert Sun editorial reporters, editors and Desert Hot Springs
councilmembers Mary Stephens and Hank Hohenstein. (I'd be
afraid of what they might find too!)
Last but not least, comes an article from Cindy Uken in the Desert
Sun full of lies from dubious sources and disgruntled ex-employees.
Notice that neither Hanson nor the City Council will admit to
any of
this nonsense publicly? Oh yeah, I forgot. They can't
talk about it.
Its a personnel matter. So leak some crap to the press
and have them try and do your dirty work, trying to trash an honest,
caring guy that did his absolute best for the City of Desert Hot
Springs and was the only thing standing in the way of rampant
corruption from Hanson and the City Council.
By the way, Chief Hill, according to the Desert Sun, "has more
than 28 years in law enforcement, a master's degree in public
administration from the University of New Haven and a senior professional
certificate in human resource management. He is a graduate of
FBI National Academy and a Federal Emergency Management Agency
trained emergency manager".
He has no criminal convictions and a totally unblemished record.

About the Uken article in the Desert Sun, is the City Manager's
"private investigation firm" going to investigate how the Desert
Sun
obtained a confidential personnel letter from Lt. Judd, and a
confidential letter from the Mayor to Dr. Steier? Or is
this okay for
Hansen to release this info if it serves his purpose? Uken
said
knowing some detail paints a different picture of the chief.
I think
it shows how slimy these people really are and how low they will
stoop
to stay in power. Hansen needs to go along with the
entire city council

reviewing our City Manager's Contract tell us that even though
our leaders don't have enough money to fund police services, they
increased Jerry Hansen's half mill contract by 3% for 2005

Jerry Hansen screw the Police?
Rumor
has it that his representatives refused to fund the police retirement
fund after he funded his own and Matt's retirement @ 2.7%. Seems
not enough money left over after others including Jerry slobber
at the trough. Rumor has it that Jerry's representatives later
offered police 2% @ age 50 AND delayed starting coverage one year
to June 2006 to save $160,000. Interestingly how Jerry and
Matt were not willing to make the same 1 year delay sacrifice
to save the city even more money.

Maybe Chief Roy Hill was fired because there was not enough money
to pay for 1) required police over time, 2) fund police
retirement, 3) keep a full time dedicated Police Chief and 4)
pay almost a half million dollars in cash and perks a year
to our General manager Jerry Hansen!
Unsubstantiated
rumor (we are trying to verify) is that Roy Hill was not willing
to cut back on police services (screw the police) to save the
money Jerry needed to spend elsewhere!
Of
course maybe Jerry Hansen could become our new full time Police
Chief! He could add that position to all the other positions
he presently gets paid for! With his salary, we should get at
least 6 more job positions out of him.
We
can be assured that our council members will follow Jerry like
a bunch of blind dogs of a cliff if that is were he decides to
take our city.
Forgot!
Been there, done that..... a few times!
We

experience with our City Council should tell us that our representative
have little regard for us and at times have appeared to be even
contemptuous of our citizens right to know.
In
all probability, Roy was fired because he was a stand-up Boy Scout
guy. When Roy was given the choice to do what's right or do what
our manager and council told him to to do, it would have been
in keeping with his character to choose the "what's right”
option.
We
can only speculate as to why our secret Star-Chamber fired him.
Our representatives have relied upon the comfort zone of personnel
matters confidentiality to keep the citizens uniformed in this
matter.
Our
representatives have consistently made many of the decisions that
affect us all in the realm of closed sessions away from the sight
and hearing of the public. They do this under the caveat of discussing
personnel or potential litigation matters. Of course any form
of good or bad behavior on their part can be conveniently hidden
under this broad title of "employment and personnel/litigation”
matters.
Since
our leaders tell us nothing, we can only judge their recent dealings
from past history as to what may be their real intent.
Let's
see:
Case
in point #1
Remember
when DHS Economic Development Commissioner, Alex Bias, raised
the issue publicly about how incredibly wrong it was for our city
council to vote to extend their own terms an additional 2 years?
This action by council would have made our elections moot or irrelevant.
Of course, if our City Council got away with doing this, they
would have been able to elevate their positions from our representatives
to our rulers. Adolph Hitler and other dictators who gained power
through the electoral process come to mind here. Our City
Council's actions violated everything that our founding fathers
had in mind.
Not
surprisingly our City Council removed Alex Bias from the Economic
Development Committee. Alex made the mistake of standing
with our founding fathers in defense of our representative republic
and against the “wannabe be” City Council dictators. Our
City Council also rewarded the rest of the honorable committee
members by disbanding the entire DHS Economic Development Committee.
We suppose that our wise leaders decided that DHS is the last
place on Earth that needs an Economic Development Committee.
Case
in point #2
Remember
when our city council fired the entire Planning Commission without
ever giving an explanation, even to this day? From what
we have pieced together, this termination happened when our planning
staff decided to purposely misinterpret our planning codes and
actually secretly re-wrote our code, at least verbally, so as
to arbitrarily discriminate
against Mid-Century Modern Architecture. The Chairman
and one Commissioner stood up against this discrimination.
The Chairman scheduled a Planning Commission meeting to opine
and advise Council on the staff- misinterpreted code. Well,
mid-level staff members cancelled the Planning Commission meeting,
and our Council fired the entire Planning Commission. Of
course, in the spirit of being above the law, they fired the Planning
Commission without public notice.
Representative Democracy is not apparently allowed in DHS.
Seems
like there may be a pattern here.
Here
are some questions that our citizens may want to ask:
1)
Why was our Police Chief, Roy Hill, fired?
2)
Why is it that our City Council and City Manager to this day refuses
to give us any information on this or past firings?
3)
Was Roy fired because he did what was right for DHS citizens and
police instead of doing what is right for our star-chamber City
Council?
4)
Was Roy possibly getting too close to uncovering illegal corruption
on the City Council or Manager level?
5)
Was Roy fired because he was carring out sound policy regarding
protecting our citizens from crime instead of protecting
criminals inside and outside of our city hall?
6)
How does our Council/Manager firing of this award- winning Police
Chief for no readily apparent reason benefit the citizens of DHS
whom they were sworn to serve and protect.
7)
How in any way does this firing effect in a positive manner the
City's ability to attract a future qualified Police Chief?
8)
What does this Firing effect the moral of our police department
personnel?
9)
How can this arbitrary firing in any way make our city safer?
10)
What perception will this action create among the other Coachella
Valley cities? Can you say "Laughing Stock of the Valley?"
11)
Our citizens are paying a greater than $8 million dollar bond
to pay off past discrimination litigation. Will further secret
Council/Manager discriminatory actions lead to opening our citizens'
pockets to pay for additional, justified litigation?
12)
Do we need to ask for copies of the W2's from our Council and
Manager?
13)
Do we need the FBI to investigate these secret shenanigans?
14)
How is it likely and reasonable in this city or in
any city, that so many citizen volunteers who have participated
in the process of local government should be found to be so wrong
in their thinking, so outrageous in their behavior as to need
to be removed from their appointments as seems to have happened
here with such frightening regularity?

is even worse than we thought!!!!!
Our new chief was prosecuted for allegedly filing a false police
report. Our fired Chief, Roy Hill and commissioners rejected our
new chief for this same offense when he applied for a position

15) How can we fire 4 DHS police officers for allegedly filing
a false police report then replace our current chief with
a new chief that was prosecuted for the exact same offense?
16)
How can this action not increase the city's liability
for a "wrongful termination" from these 4 officers? The
offense was very minor in nature. Even so, we need to treat everyone
equally and not arbitrarily discriminate by fired officers because
they were not crony friends of Council members.

These officers are now appealing the decision to fire them. Are
they justified? Probably so! They now have a excellent
bases to sue the city for wrongful termination. What was
our leaders thinking. Unequal application of the law is not justice.
Our sources tell us that this carnage has not ended, so stay tuned
for more future gory details of the reckless petty city leadership
determined to undo the positives by constantly eating their young.

18) Maybe
it's about time to "fire those that are firing others! Some of
our Council leaders have expressed to us that it is good to have
a new Chief because our city is growing. This attitude reminds
us of the old TV show "Queen for a day". Maybe
that is what our "leaders" have in mind, "Chief
for a day or week or even a /month". Maybe a better
alternative would be to replace our current leadership with new
leadership instead.
Clarification
in regard to
Chief Walter McKinney
We
want to state for the record that we hold no bad will against
our new Chief, Walter McKinney.
From what we have read, McKinney has a very effective record as
Policeman and Chief and has helped to significantly reduce gang
crime in the City where he served. He will be a positive
asset to our City. He has paid for his past very minor offence.
No one of us are perfect by any means.
He
is also faultless in regard to the issues of Roy's firing. As
long as Walter McKinney is our Chief, we need to support him in
his efforts to make our city a safer place to live and wish him
the best of luck and will be behind him supporting his efforts.
McKinney and our City deserves nothing less.
