For Sober Age Center Homeless Shelter
on Mountain View Avenue, DHS

DHS Zoning Ordinance Table 04.01; Homeless Facilities are only allowed within an R-M , R-H or R-VS Land Use District subject to a Conditional Use Permit.

This facility is under the provisions of State law which allow Alcoholism Recovery Facilities (11834.02 etc)....the State in Section 11834.23 has adopted Zoning Preemption provisions which specify that “no conditional user permit , zoning variance , or other zoning clearance shall be required of an alcoholism or drug abuse recovery or treatment facility which serves six of fewer persons that is not required of a single-family residence in the same zone.”

If the amount of persons in this facility exceeds the number of persons allowed by State law (seven or more persons) then it would fall within the regulatory jurisdiction of the City. Most likely it would fall under the City’s provisions for Group Housing which are only allowed within the C-G Land Use District subject to a Conditional Use Permit.  Said facility building is within a RL-VS Land Use District but the building is a legal non conforming building as it had office/medical uses operating out of it in the past.

A review of this Building Permit packet contains written conditions from the Planning Department as follows:  

  1. Facility can only serve 6 or fewer persons.
  2. Gift shop is not a permitted use.
  3. All existing buildings, landscaping , and walls must be maintained.
  4. No new signage is permitted.
No exterior changes to building are permitted
